1. About Gemélia & Co.
These Terms of Service govern your use of the Gemélia & Co. website at gemelia.jewelry (the "Site"), operated by Gemélia & Co., a gemstone sourcing business based in Melbourne, Victoria, Australia.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
2. Nature of Our Business
Gemélia & Co. is a gemstone importer and trader sourcing coloured gemstones directly from Sri Lanka. We operate as an enquiry-based business. The Site does not process automated purchases — all transactions are conducted through direct negotiation and agreement between Gemélia & Co. and the buyer.
All gemstone listings on this Site are for informational and enquiry purposes only. Displaying a gemstone on this Site does not constitute a binding offer to sell at any stated or implied price.
3. Enquiries and Purchases
When you submit an enquiry through this Site, you are expressing interest in a gemstone. No contract of sale is formed until both parties have agreed in writing to the specific terms of a transaction, including price, payment method, and delivery arrangements.
Gemélia & Co. reserves the right to decline any enquiry or transaction at its sole discretion.
4. Gemstone Descriptions and Accuracy
We make every effort to accurately describe gemstones listed on this Site, including species, variety, origin, weight, dimensions, and treatment status. However:
- Colours displayed on screen may vary depending on your device's display settings and calibration.
- Gemstone weights and dimensions are provided to the best of our knowledge and may have a minor tolerance.
- Where laboratory certificates are referenced, the certificate is issued by an independent third party. Gemélia & Co. is not responsible for the findings or conclusions of any gemological laboratory.
- Origin determinations are based on available evidence and are not guaranteed.
We strongly recommend that buyers obtain independent gemological verification before completing any significant purchase.
5. AML/CTF Compliance
Gemélia & Co. operates in compliance with Australia's Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act). All purchases are subject to identity verification. We reserve the right to request government-issued identification and other documentation before completing any transaction. We are required by law to report suspicious transactions to AUSTRAC.
6. Intellectual Property
All content on this Site — including text, photographs, gemstone descriptions, brand assets, and design — is the property of Gemélia & Co. and is protected by Australian and international copyright law.
You may not copy, reproduce, republish, distribute, or use any content from this Site for commercial purposes without prior written permission from Gemélia & Co.
7. Privacy
Your use of this Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We handle personal data in accordance with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs).
8. Limitation of Liability
To the maximum extent permitted by Australian law, Gemélia & Co. is not liable for:
- Any loss or damage arising from reliance on information published on this Site;
- Any indirect, incidental, or consequential loss arising from the purchase or use of gemstones;
- Any loss arising from delays, errors, or interruptions in the operation of the Site.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
9. Australian Consumer Law and Returns
Our gemstones come with guarantees under the Australian Consumer Law (ACL) that cannot be excluded by agreement. You may be entitled to a remedy where a gemstone has a major failure or does not match its description as provided at the time of sale.
However, the following do not constitute a defect or failure under these Terms or the ACL:
- Natural inclusions, growth features, colour zoning, or other characteristics inherent to natural gemstones;
- Variations in colour appearance due to lighting conditions, photography, or screen calibration;
- Treatments or enhancements that were disclosed prior to or at the time of sale;
- Change of mind, preference change, or a buyer's reassessment of value after purchase;
- Any damage, alteration, or deterioration caused by wear and tear, including scratching, chipping, abrasion, or surface damage occurring after the stone has left the possession of Gemélia & Co.;
- Any damage resulting from mishandling, improper storage, exposure to chemicals, ultrasonic cleaning, heat, or any other treatment applied to the gemstone by the buyer or any third party after purchase;
- Any damage caused by setting, mounting, drilling, cutting, or other lapidary or jewellery work carried out after purchase;
- Any change in appearance resulting from the natural behaviour of the gemstone under normal use, including the lightening or darkening of certain colour-change or photosensitive varieties.
Gemélia & Co. strongly recommends that buyers consult a qualified jeweller or gemologist regarding the appropriate care, hardness, and suitability of any gemstone before having it set or worn. Different gem species have different hardness ratings and care requirements. Damage resulting from setting a gemstone in a manner inconsistent with its physical properties is the sole responsibility of the buyer.
Returns and verification procedure: Any claim that a gemstone does not match its description must be supported by a written report from an accredited gemological laboratory — such as GIA, Gübelin, SSEF, AGL, or Lotus Gemology — obtained at the buyer's expense. Gemélia & Co. reserves the right to verify the identity of any returned stone against photographs, weight records, and other documentation taken at the time of sale before accepting any return.
Gemélia & Co. will not accept returns where there is any reason to believe the stone presented for return is not the stone originally sold, or where the stone shows evidence of damage, alteration, or wear occurring after the time of sale. All returned stones will be weighed, measured, and examined against original sale documentation prior to any remedy being provided.
Nothing in this clause excludes any guarantee or right that cannot be excluded under the ACL.
10. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
